Anti-SLAPP Cases Highlight Dismiss Standard Disparity, examines the Colorado Court of Appeals’ decisions in two recent cases that provide a procedural quandary about “strategic litigation against public participation.” Because the rulings apply two contrasting standards for courts evaluating anti-SLAPP motions, he explains, the Colorado Supreme Court will likely need to resolve the issue.
“Although this may seem a technical, procedural issue, a decision from the Colorado Supreme Court will establish the rule going forward for all anti-SLAPP cases and will have a significant effect on how fruitful anti-SLAPP motions can be,” Jacob said.
