Jacob Hollars Discusses Colorado Courts’ Anti-SLAPP Quandary for Law360

April 2, 2025

Spencer Fane attorney Jacob Hollars recently guest-authored an article for Law360.

Jacob’s article, Colo. Anti-SLAPP Cases Highlight Dismiss Standard Disparity, examines the Colorado Court of Appeals’ decisions in two recent cases that provide a procedural quandary about “strategic litigation against public participation.” Because the rulings apply two contrasting standards for courts evaluating anti-SLAPP motions, he explains, the Colorado Supreme Court will likely need to resolve the issue.

“Although this may seem a technical, procedural issue, a decision from the Colorado Supreme Court will establish the rule going forward for all anti-SLAPP cases and will have a significant effect on how fruitful anti-SLAPP motions can be,” Jacob said.

At Spencer Fane, Jacob is a trial and appellate lawyer specializing in employment issues, real estate, special district, and commercial matters. He represents clients through all phases of litigation on a wide variety of matters in both state and federal courts.
