Spencer Fane attorney Shawn Tuma was a guest author for the Texas Bar Journal (TBJ)’s special December issue, 2024: The Year in Review.
For this special feature, the TBJ Board of Editors assembled a series of articles highlighting significant developments across multiple areas of law over the past year. Shawn authored the Cybersecurity and Data Privacy section.
“This year will be remembered as a watershed moment in Texas data privacy law,” he opined. “On July 1, 2024, Texas’ comprehensive data privacy law, the Texas Data Privacy and Security Act (TDPSA) went into effect, but that is not the reason. The reason is the enforcement activity by the Texas Office of the Attorney General (OAG).”
Shawn outlined the ways the Texas OAG has increased enforcement activity for the state’s cybersecurity, data protection, and data breach notification requirements. He also spotlighted case developments in unauthorized access claims under Texas’ Harmful Access by Computer Act.
At the firm, Shawn co-leads the firm’s Data Privacy and Cybersecurity Practice Group while serving as Office Managing Partner for the firm’s Plano location.
