Jamie Cotter Explains Reasonable Good Faith Offers in Colorado Real Estate Journal

Spencer Fane attorney Jamie Cotter recently authored an article published in the Colorado Real Estate Journal that outlines what constitutes a ‘reasonable’ good faith offer for condemnation negotiations.

Her article, Condemnation Negotiations: Reasonable Good Faith Offer, was originally published on the firm’s website. In it, Jamie shared the following:

“As an eminent domain practitioner, in every instance in which I have had to file a petition for condemnation, I have yet to see a situation where a condemning authority and landowner agreed about what compensation was ‘appropriate,’ ‘fair’ or ‘honest.’”

Jamie then explained what is and isn’t required to meet lawful standards, offered tips, and provided best practices that reduce the need for litigation.
