Andrew Brought Discusses Masks and COVID-19 Safety Measures with Business Insurance

Spencer Fane attorney Andrew Brought was recently featured in a Business Insurance article covering concerns over the Center for Disease Control’s (CDC) updated mask guidelines and the potential for PPE shortages regarding N95 respirators for the healthcare community.

Titled “New guidelines could hamper medical sector’s efforts to get PPE,” the article explains that conflicting guidance on the use of N95 respirators and resulting shortages have caused a dilemma for employers. According to Andrew, “problems with sourcing N95 masks will continue, and that any call for the public to wear such masks ‘presents a dilemma and challenge for health care professionals and their employers because they are the ones most directly at risk.’” As Andrew explained, “PPE should be directed to all those employers who are in the high-risk categories.”

Andrew also provided insight for health care systems faced with Occupational Safety and Health Administration (OSHA) citations, explaining the need to “demonstrate that they have taken a variety of [safety] measures” when disputing citations.
