Helen Holden Discusses the “Nightmare” of ADA Compliance in the Era of COVID-19

Spencer Fane attorney Helen Holden recently published an article for Recruiter Today on the challenges for employers to handle compliance under the Americans with Disabilities Act (ADA) in the era of COVID-19.

Titled “ADA Compliance Can Be Tough in the Age of COVID. Here’s What You Need to Know.,” Helen’s article highlights the difficulties with ADA compliance in ordinary circumstances and the ways in which the pandemic has compounded challenges.

“Under the ADA, employers must reasonably accommodate qualified employees with disabilities, unless doing so would create an undue hardship for the employer,” Holden wrote. “The ADA also imposes obligations on employers in conducting medical examinations and in seeking and maintaining medical information for all applicants and employees. In the midst of the COVID-19 pandemic, these complexities of ADA compliance are multiplied.”
