Eric Van Horn and Judge Stacey Jernigan Explain Consequences of New Bankruptcy Law on Preferences

Spencer Fane partner Eric M. Van Horn (based in Texas) co-authored an article with the Honorable Stacey G. C. Jernigan (United States Bankruptcy Judge for the Northern District of Texas, Dallas Division) that was published in the Dallas Bar Association’s Headnotes on recent reforms to the bankruptcy code.

Titled “New Bankruptcy Law Impacts Preference Litigation,” the article outlines the changes to preference laws, the potential impacts on preference litigation and the questions this may present for clients and counsel.

The questions and issues will undoubtedly be litigated and the subject of future court rulings and opinions,” Eric and Judge Jernigan, wrote in the article. “However, in the meantime, plaintiffs may want to err on the side of caution and attempt to over-comply with the Diligence Requirement.”
