Spencer Fane attorney Scott Sandberg, recently presented a webinar for the Colorado Bankers Association (CBA) on the current economic downturn and the increased lending claims and litigation as a result.
Titled “Avoiding and Effectively Dealing With Lender Liability Litigation During a Downturn,” the presentation outlined measures lenders can take to avoid, minimize, and effectively deal with such claims and litigation. Scott elaborated on:
- Identifying loans, borrowers, and collateral likely to produce litigation;
- Best practices for loan forbearance, modification, and workout negotiations and documentation;
- Common lender liability claims and defenses; and
- Best practices for record preservation and discovery.
